2. Description of Service
Habeas is an AI-powered legal research platform that assists Australian legal professionals in conducting research and analysis.
3. User Account Security and Setup
- You are responsible for maintaining the confidentiality of your account and password.
- You must not share your account details or credentials with other individuals. You are responsible for activities and prompts submitted via your account.
- You agree to accept responsibility for activities that occur under your account, including any actions that breach the terms of service.
- If your account has access to Habeas due to your status as employee of a particular entity, you represent and warrant that you are authorized to act in accordance with the contractual terms established with that entity.
4. Acceptable Use
You agree not to use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload or transmit viruses or malicious code
- Attempt to gain unauthorized access to the Service
- Disclose confidential client information
- Spam or query the platform with unfaithful or unreasonable requests
5. User Data and Confidentiality Requirements
- You are solely responsible for ensuring that your use of the Service complies with your professional obligations, including respecting client confidentiality.
- You agree not to upload or disclose any confidential client details to the Service, and not to upload files which contain private client information.
- You agree to anonymize or de-identify any sensitive details before using the Service.
- Habeas may analyze and retain user input to improve the Service but does not assume responsibility for the legality or appropriateness of your submissions.
6. Privacy and Data Protection
- You acknowledge that our collection and use of personal information in connection with the Service is as described in our Privacy Policy.
- By using Habeas, you acknowledge and agree to our data collection and usage practices as outlined in that policy.
7. Content and Intellectual Property Rights
- You recognise that conversations on the Habeas platform can be analysed and retained by the Service Provider for the purpose of providing and improving the Service.
- The Service and its original content, features, and functionality are owned by the service Provider and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
- You must not license, sub-license, sell, re-sell, lease, transfer, distribute or otherwise make any portion of the Habeas software or application content available to third parties.
- You must not disclose any conversations or information accessed on the Habeas platform to users or organisations that are not subscribed to Habeas, or authorized to access the Service.
8. Disclaimer and Limitation of Liability
- The Service is provided "as is" and "as available" without any warranties of any kind.
- You acknowledge that the Service is a research tool and does not constitute legal advice. You are responsible for your own legal analysis and conclusions.
- Answers provided account for the needs and research requirements of many individuals. Thus, the application will not always account for your specific circumstances or existing understanding of a legal issue, and there will be times when an answer provided is not what you expected. To the extent permitted by law, we make no representation or warranty regarding the accuracy of the answers.
- You acknowledge that the Habeas application provides opportunities for users to trace the sources of information that have been used to inform a particular answer, giving users some oversight and understanding regarding the completeness of any provided answer. You acknowledge that Habeas draws on a wide range of information and will not always optimise for the most temporally 'recent' data to provide an answer.
- Further, answers provided by Habeas are by nature subjective within the boundaries of law, and thus might be only partially correct or warrant further examination by the researcher. Users should evaluate answers and implement critical oversight when engaging with any answers provided by Habeas.
9. Indemnification
You agree to indemnify and hold harmless the Service Provider from any claims, losses, or damages, including legal fees, resulting from your violation of these Terms or your violation of any rights of a third party.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach the Terms.
